Undersong Mood library — Terms of Use
Version 1.0 · Effective 2026-10-30 · https://moods.bshk.app/terms
Short version
- You need an account to publish a mood. You can hide your name, but every mood you publish stays linked to your account.
- Publish only what is yours to share. Don't copy anyone else's music, words or other work.
- When you publish a mood, you give us and other Undersong users the rights described in section 6.
- Moods go live right away. We don't check them first. Anyone can report a mood.
- If you delete a mood, the copies other people already added stay on their Macs.
- Music made by AI may not be protected by copyright, and the law here is still unsettled.
- The library is free and comes as is.
This summary is for convenience. The full terms below are what count.
1. Who we are and what these terms cover
Undersong is a free Mac app that writes background music on your Mac from "moods". The Mood library at https://moods.bshk.app is a public place where people publish their moods, and where anyone can find a mood and add it to Undersong.
"BSHK", "we" and "us" mean Aleksandr Beshkenadze, a private individual in Finland who publishes Undersong under the BSHK brand. Contact: support@bshk.app.
These terms cover the Mood library (browsing, adding, publishing and reporting moods) and your Undersong account. The Undersong app itself has no separate terms of use. The licences of the third-party parts it uses, including the Stability AI Community License, come with the app.
Two other documents apply too:
- the Copyright and Content Policy (https://moods.bshk.app/copyright), which explains reports, takedowns, counter-notices and repeat infringers. It is part of these terms;
- the Privacy Policy (https://moods.bshk.app/privacy), which explains how we handle personal data.
You agree to these terms when you create an account or publish a mood, and you accept them by using the library. If you don't agree, don't use the library.
2. Who can use the library
- You must be at least 16 years old to create an account or publish a mood.
- If you use the library for a company or another organisation, you confirm that you may accept these terms for it.
- You can't use the library if we have closed your account under these terms, or if the law forbids you to use it.
- You must follow the export control and sanctions laws that apply to you.
3. Your account
- You sign in with a one-time 6-digit code that we send to your email. There is no password. Browsing and adding moods don't need an account.
- If you turn on sync in Undersong, the same account keeps your moods the same on all your devices. We store synced moods only for that, they stay private, and section 6 doesn't apply to them — it covers only moods you share to the library.
- Keep access to your account safe. You are responsible for what is done with it. If you think someone else used it, write to support@bshk.app.
- Pick a display name that doesn't pretend to be another person or brand, and that follows section 7.
- Hiding your name. You can publish a mood without showing your name. Other users then won't see who published it. We still know, the mood stays linked to your account, and we may reveal who you are when the law requires it (for example, a court order or a subpoena). If you send a counter-notice about a copyright removal, the law requires us to pass your name and contact details to the person who complained (see the Copyright and Content Policy).
4. Publishing a mood
4.1 What is published
A published mood contains:
- its name, its symbol and a description;
- tags for its two ends, Calm and Energetic (for example genre, instruments, mood and BPM);
- your words for each end — the text Undersong uses to write the music;
- a 20-second preview of the end you pick;
- your display name, unless you hide it, the publication date and how many times the mood has been added.
All of this is public. Don't put personal information in a mood, yours or anyone else's. Symbols come from Undersong's own set and remain ours. Your tracks, songs, hearts and skips stay on your Mac.
4.2 The preview
Undersong makes the preview on your Mac with Stable Audio 3, an AI model by Stability AI. The library labels it "AI-generated preview". It is one sample of the end you pick. Music made from the same mood will sound different on other Macs, at other settings and in other versions of Undersong.
4.3 Moods made from a song
Undersong can build a mood from a song on your Mac. Only the mood's tags and your words are published. The song itself never leaves your Mac, and the preview is made from the published tags, not from the song. Don't put the song's title, the artist's name, its lyrics or any other part of the song in the mood. A mood made from a song is still subject to every rule in these terms.
4.4 No review before publishing
Moods appear in the library as soon as you publish them. We don't review them in advance and we don't endorse them. We can restrict or remove them later (section 8).
4.5 Your promises
Each time you publish or update a mood, you promise that:
- you made it, or you have permission to publish it and to give the rights in section 6;
- it doesn't copy or infringe anyone's copyright, trademark or other rights — including music, recordings, lyrics, text and artwork by someone else;
- it follows section 7 and the law;
- its preview was made by Undersong from this mood and contains no other audio.
5. Adding a mood
When you add a mood, Undersong keeps a copy on your Mac and writes your own music from it. You can change your copy. Moods are made by other users, not by us: we can't promise that a mood is lawful, accurate or sounds like its preview. A publisher can only give you the rights they actually have. If a mood you added is removed after a report, your copy keeps working in Undersong, but if the removal was for someone's rights, the permission in section 6.3 may not protect you.
6. Rights in moods
6.1 You keep your rights
We don't take ownership of your moods. Tags, BPM values and short names are often not protected by copyright at all. This section covers whatever rights you do have.
6.2 What you allow BSHK to do
When you publish a mood, you give BSHK a non-exclusive, worldwide, royalty-free licence to:
- store, copy, show and distribute the mood and its preview — in the library, in Undersong and on our websites;
- change, adapt, translate and combine it with other content, and make new moods from it;
- use the mood, or moods based on it, in Undersong, including as built-in moods that ship with the app;
- use it to promote Undersong and the library, for example in screenshots, videos, posts and app listings. If you hid your name, we won't show it.
Our service providers (for example hosting and storage) may do these things on our behalf. We may transfer this licence to anyone who takes over Undersong. We don't have to pay you or name you.
We don't use moods or previews to train or improve generative AI models.
6.3 What you allow other users to do
Everyone who adds your mood gets a non-exclusive, worldwide, royalty-free, permanent and irrevocable licence to keep a copy, use it in Undersong, change their copy, make music with it, and share it through Undersong's own sharing features (for example, inside a shared track).
They may not publish your mood in the library, even in a changed form.
6.4 How long the licence to BSHK lasts
BSHK's licence in 6.2 lasts while your mood is in the library. When you delete the mood or your account, it ends, except that:
- licences other users already have under 6.3 stay in force — we can't remove copies from their Macs;
- we may keep using built-in moods and promotional material that we made from your mood before you deleted it, including in versions of Undersong already released. We won't use a deleted mood in new built-in moods or new promotion;
- we may keep backups and records as section 9 explains.
6.5 Credit and changes
You agree that BSHK and other users may use your mood without naming you, and may change it. If the law where you live gives you moral rights that can't be waived, you agree not to enforce them against the uses these terms allow, as far as that law permits.
6.6 Music made from a mood
- Neither the publisher of a mood nor BSHK claims any rights in the music you make with Undersong.
- Under the Stability AI Community License, as between you and Stability AI, you own the audio the model generates "to the extent permitted by applicable law".
- The law on AI-generated music is unsettled. In many countries, including the United States, works made by AI without enough human creative input are not protected by copyright. So the music you make may have no copyright protection, someone else may make the same or very similar music from the same mood, and we can't promise you exclusive rights in it.
- We can't promise that music made by AI doesn't resemble existing music. You decide how to use it, and you take that risk.
7. Rules
Don't publish a mood — including its name, words, description, preview or your display name — that:
- copies or infringes someone else's rights: their music, recordings, lyrics, text, artwork or trademarks;
- is someone else's mood from the library, changed or not;
- uses the name of a real artist, band, song, album, label or brand, unless it is yours, or suggests that someone endorses the mood;
- contains personal information, such as an email address, a phone number or a home address;
- is illegal; threatens or harasses anyone; promotes violence, or hatred against people because of who they are; is sexually explicit; or involves or exploits minors in any way;
- impersonates anyone, or misleads people — for example, by saying the preview was made by a human;
- is spam, advertising, or an attempt to game search or rankings;
- breaks the Stability AI Acceptable Use Policy (https://stability.ai/use-policy).
And don't:
- scrape, bulk-download or mirror the library, except through features we provide;
- use the library, moods or previews to train or improve AI models (the Stability AI licence forbids using its outputs to build or improve other foundational generative AI models, and previews are such outputs);
- interfere with the library, probe it for security holes without our permission, or get around its limits;
- create a new account to get around a suspension or closure;
- send reports you know are false or abusive.
8. Reports and moderation
8.1 Reporting
Every mood page has a Report it link ("Something wrong with this mood?"). Use it to tell us that a mood infringes copyright, is otherwise illegal, or breaks these terms. The Copyright and Content Policy explains what to include and what happens next.
8.2 How we decide
A person reviews reports. We may use automated tools to spot spam and abuse; if a decision about you used automated means, we'll say so. We act carefully, objectively and in proportion, and we take into account the rights of everyone involved, including freedom of expression. We may also act without a report.
8.3 What we can do
We can:
- remove a mood or disable access to it, in all countries or only where it is illegal;
- limit how visible a mood is, for example by leaving it out of search or featured lists;
- change or remove a display name that breaks these terms;
- stop you publishing for a time;
- suspend or close your account.
8.4 We tell you why
When we restrict your mood or account, we give you a statement of reasons — by email and under Why? next to the mood in My moods. It says what we did, where and for how long; the facts we relied on and whether a report triggered it; whether automated tools were used; the legal rule or the part of these terms involved and why it applies; and how you can challenge the decision. We may skip this when the law forbids it, when we have no way to contact you, or for spam.
8.5 Challenging a decision
You can dispute each decision once, within 6 months: press Dispute next to the removed mood in My moods, or reply to our email. Include everything that matters, because there is no second round. It is free. A person reads every reply, and we reverse the decision if it was wrong. Disputing doesn't limit your other options: for copyright removals you can also send a counter-notice (see the Copyright and Content Policy), and you can always go to court.
8.6 Repeat offenders and misuse
We close the accounts of repeat copyright infringers, as described in the Copyright and Content Policy. After a warning, we may also suspend accounts that often publish clearly illegal content, and stop handling reports from people who often send clearly unfounded ones.
8.7 Threats to life or safety
If we learn of information that suggests a crime threatening someone's life or safety, we report it to the authorities.
9. Deleting moods and your account
- You can delete a mood at any time in My moods, on the website or in Undersong. Its page stops working and it leaves search within 7 days, usually at once. The mood stays in your own Undersong.
- You can delete your account at any time, also in My moods: sign in again and confirm. Deletion finishes in the background. It removes your profile, sessions and sign-in tokens, your synced moods and their history, and the moods you published, with their versions, previews and add records.
- After deletion:
- copies that other users already added stay on their Macs, and their licences under 6.3 continue;
- section 6.4 applies to built-in moods and promotion made before deletion;
- deleted data may remain in backups for up to 30 days;
- we keep technical deletion markers. They contain your account's pseudonymous ID, the deletion's IDs and times and a hash of the deletion event, and for each mood you published a removal marker: its old link, revision number, removal time and total add count. They contain no email, display name, sign-in codes, tokens, mood contents, words, tags, sound guides, audio or songs. They have no set end date: they stop a deleted account and its moods from coming back, including through sync (see the Privacy Policy);
- we keep records we need by law or to handle legal claims — reports, disputes, counter-notices, decisions, strikes, moderation records, proof that you accepted these terms, and a mood's version and preview kept for a case — for up to 3 years. If your account was closed for breaking these terms, a keyed hash of its email is kept for up to 3 years so it can't come back.
10. The library and other parts
- The library is free. We may change, limit or stop it, or any part of it, at any time. If we shut it down, we'll try to give 30 days notice. We don't promise to keep any mood available.
- Stable Audio 3. Undersong uses Stable Audio 3 by Stability AI under the Stability AI Community License (https://stability.ai/license) — Powered by Stability AI. When you make music with Undersong, you must follow that licence and the Stability AI Acceptable Use Policy. If you use the music for a commercial purpose, that licence may require you to register with Stability AI, and it ends for anyone whose annual revenue, with affiliates, is above USD 1,000,000. Read the licence before such use.
11. No warranties
The library, the moods and the previews are provided as is and as available. To the extent the law allows, we give no warranties of any kind — including that moods are lawful, accurate or suitable for you, that previews represent the music a mood makes, or that the library will always work or keep your data.
12. Liability
- To the extent the law allows, we are not liable for indirect or consequential loss, lost profits or lost data. Because the library is free, our total liability to you for all claims about it is limited to USD 50.
- If you are a consumer, these limits apply only as far as the mandatory consumer law of the country where you live allows. Where that law gives you more protection, it applies.
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for intentional or grossly negligent conduct.
- If you break these terms or publish content that infringes someone's rights, and someone makes a claim against us because of it, you will cover our reasonable costs and losses, to the extent the law allows.
13. Changes to these terms
We may change these terms. For important changes, we'll tell you at least 30 days in advance in Undersong, in the library or by email. If you keep using the library after the change takes effect, the new terms apply. If you don't accept them, delete your account. Changes don't apply to disputes that started before them.
14. Ending
You can stop using the library at any time. We can suspend or close your account as section 8 explains. Sections 6.3–6.6, 9, 11, 12 and 15 continue after your account ends.
15. Law and disputes
These terms are governed by the laws of Finland, and disputes go to the courts of Finland. If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may bring a claim in its courts.
16. Contact
- General questions: support@bshk.app
- Point of contact for users and for EU authorities (Digital Services Act, Articles 11–12): support@bshk.app. Languages: English and Finnish.
- Copyright notices and counter-notices: support@bshk.app, as the Copyright and Content Policy explains.
17. Other things
- These terms, with the Copyright and Content Policy, are the whole agreement between you and us about the library.
- If a court finds part of these terms invalid, the rest still applies.
- If we don't enforce a term right away, we can still enforce it later.
- You may not transfer these terms to anyone else. We may transfer them to anyone who takes over Undersong.
- If we translate these terms, the English version prevails, unless the law where you live says otherwise.
